Federal Judge Mandates Freedom of Abrego Garcia from Immigration Detention
A federal judge has ordered the prompt release of Kilmar Abrego Garcia from detention by ICE, finding his continued confinement lacks legal authority.
"Since Abrego Garcia's release after erroneous detention in El Salvador, he has been re-detained, again without legal justification," the judge wrote in her ruling.
The case stems from a mistaken removal to El Salvador in March, which the government later admitted was an error. Following his return to the United States to face human smuggling charges, he was held in immigration detention.
In her decision, the judge noted that the authorities lacks a current deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "at this juncture."
Context of the Case
The court challenge involve conflicting claims. While the Trump administration argues that Abrego Garcia is a affiliate of the MS-13 gang, he categorically denies this claim.
He has also entered a not guilty plea to the smuggling counts, which are part of a separate criminal case in Tennessee.
Conditions of Freedom
The judge, who was overseeing his challenge to removal in a federal court, ruled that he must now comply with the conditions of his bond from custody in Tennessee. This order effectively transfers his monitoring to the Tennessee court.
This decision marks a notable turn in a complicated legal case featuring allegations of wrongful detention and contested gang affiliations.
